There are two categories in child custody:  legal and physical custody.

While your relationship may be over, children are the priority when determining child custody.  There are child custody guidelines that help parents if a custody and visitation plan is not established during the divorce. In that case, the court may appoint a neutral third party to conduct a custody evaluation.

Child Custody

Legal custody:

Joint Custody: Involves the medical and educational decisions of the child or children in the marriage. In most cases, the decision is to appoint joint custody to the parents.

Sole Custody is when only one parent can make such decisions on the children. The other parent who does not have custody will need permission from the sole custody parent to access any records of the child and for any other matters relating to the children.

Physical custody implies with whom the child resides with.  A schedule will be formulated or tailored to have both parents spend time with the child.

Divorced parents are both responsible for the contribution to their children’s financial needs. It is best to have a plan in place to avoid future confrontations and disagreements.

In New Jersey, child support is calculated based on a set of guidelines.
